This handbook offers guidance on the use of the EU Charter of Fundamental Rights (the Charter) at national level. According to Article 51 of the Charter, and in contrast with international and national human rights instruments, the “field of application” of the Charter is limited to areas falling within the scope of EU law. It is not meant to extend the field of application of Union law. However, as the case law of the Court of Justice of the European Union (CJEU) shows, the Charter is a highly relevant instrument for legal practitioners, including all those who work in law and policymaking.This handbook offers a practical orientation on the scope of the Charter. It is not meant to deal with all details or to be complete. While it is based on the case law of the CJEU, it cannot replace a case-by-case assessment and the need to consult legal services as appropriate.
