This seminar will deal with, among other issues, the provisions of the EU Charter of fundamental rights in relation to asylum and immigration, the EU legal system regulating asylum and immigration (instruments and case law) and the legal assistance to immigrants and asylum seekers on the ground.

This seminar will focus on, among other issues, the European framework in relation to vulnerable migrants, the trafficking and labour exploitation of migrant workers, migrant children and migrant families, migrant women and migrant LGBTI+, and migrants with disabilities, elderly migrants, etc.

The third module on alternatives to detention for migrant children allows participants to learn about the appropriate procedures guaranteeing access to effective remedies for migrant children in detention and migrant children subject to alternatives to detention.

This handbook provides an overview of the law applicable to asylum, border man-agement and immigration in relation to European Union (EU) law and the European Convention on Human Rights (ECHR). It looks at the situation of those foreigners to whom the EU usually refers as third-country nationals, although that distinction is not relevant to cited ECHR law. This handbook is designed to assist legal practitioners who are not specialised in the field of asylum, borders and immigration law; it is intended for lawyers, judges, prosecutors, border guards, immigration officials and others working with national authorities, as well as non-governmental organisations (NGOs) and other bodies that may be confronted with legal questions relating to these subjects.

The second module provides an overview of the guiding principles on access to justice for migrants in detention. The module focuses first on the right to liberty, looking into the distinction between deprivation of liberty and restrictions on freedom of movement before discussing alternatives to detention, and the legal requirements underlying detention.

The second training module explores alternatives to detention for migrant children, looking at the legal framework and practical examples of such alternatives.

This judicial analysis is primarily intended to be used by members of courts and tribunals of EU Member States working on international protection cases. It focuses on qualification for international protection under the Qualification Directive (QD) (recast). As now updated, it incorporates the analysis of Article 15(c) QD (recast), which was originally the subject of a separate judicial analysis.
