Description

This HELP course on Family Law and Human Rights is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals (notably with EU financial support) aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level.

This course has been jointly financed by the European Union-Council of Europe "HELP in the EU" project and the European Union-Council of Europe Horizontal Facility Action "Strengthening the Human Rights Ombudsman to fight discrimination”, in cooperation with the Council of Europe Children’s Rights Division. It is addressed to legal professionals (judges, prosecutors, lawyers).

The course aims at providing a comprehensive overview of International and European family law related standards, case-law and good practices. It discusses and analyses the influence of human rights law, notably Articles 8 (private and family life) and 12 (right to marriage) of the ECHR on national family law. It addresses key cases of the European Court of Human Rights on Articles 8, 12 and 14 (discrimination) ECHR and explores relevant European and international instruments including the UN Convention on the Rights of the Child (1989), with a view of showing how human rights law sets a minimum standard for family law in Europe.

The course consists of the following 4 substantive modules:

  • Rights Related to Couples
  • Relationship between Children and their Parents and Other Relatives
  • International Child Abduction
  • Children’s Rights: Key Challenges.
