Description
This HELP course on International Cooperation on Criminal Matters is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals (HELP), with EU financial support, aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. In a rapidly changing world under the challenges of globalization and new technologies; to combat transnational crimes such as organized crime, corruption and terrorism and national crimes, mechanisms and instruments of international cooperation in criminal matters are of paramount importance. This course aims at providing an overview of fundamental principles of International judicial cooperation and a range of legal frameworks and legal instruments for cooperation-applied under a general consideration for human rights issues. The course covers extradition, mutual legal assistance, transfer of sentenced persons, supervision of offenders, international validity of criminal judgments and transfer of proceedings, seizure and confiscation of proceeds of crime, an International Cooperation Toolbox with links to relevant information and organisations related to International Cooperation in Criminal Matters, as well as Help and Guidance on making and carrying out requests. It is addressed to legal professionals (judges, prosecutors, lawyers).The course consists of the following 7 substantive modules: Introduction Legal framework Extradition Mutual Legal Assistance Transfer of Sentenced Persons Supervision of Offenders, International Validity of Criminal Judgements and Transfer of Proceedings Seizure and confiscation of Proceeds of Crime. This course has been developed jointly with the Council of Europe’s Committee of Experts on the Operation of European Conventions on Co-operation in Criminal Matters (PC-OC) and finalised using the funds of the Horizontal Facility for Western Balkans and Turkey, a Joint Programme of the European Union and the Council of Europe.
