This HELP course on Internal Displacement is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals (HELP) aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. Internally Displaced Persons (IDPs) are among the most vulnerable people in Europe and beyond, and the protection of their rights is a key tenant of international and regional human rights instruments. This course offers a comprehensive curriculum to improve the quality of the response to internal displacement, supporting those who work towards providing IDPs with access to their rights. It covers in an interactive way some of the key concepts on the protection of IDPs, giving an insight into the international and European legal framework and the case law of the European Court of Human Rights. The course is addressed to legal professionals (judges, prosecutors, lawyers).
This HELP course on International Cooperation on Criminal Matters is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals (HELP), with EU financial support, aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. In a rapidly changing world under the challenges of globalization and new technologies; to combat transnational crimes such as organized crime, corruption and terrorism and national crimes, mechanisms and instruments of international cooperation in criminal matters are of paramount importance. This course aims at providing an overview of fundamental principles of International judicial cooperation and a range of legal frameworks and legal instruments for cooperation-applied under a general consideration for human rights issues. The course covers extradition, mutual legal assistance, transfer of sentenced persons, supervision of offenders, international validity of criminal judgments and transfer of proceedings, seizure and confiscation of proceeds of crime, an International Cooperation Toolbox with links to relevant information and organisations related to International Cooperation in Criminal Matters, as well as Help and Guidance on making and carrying out requests.
This HELP course on Pharmaceutical crime and the MEDICRIME Convention is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. The falsification of medical products and other similar crimes effectively deny patients the necessary medical treatment and are harmful to the health of individuals. In addition, the circulation of counterfeit (or falsified) medical products undermines public confidence in healthcare systems. In response to this global threat, the Council of Europe has drawn up the first international treat against counterfeit medical products and similar crimes involving threats to public health, the MEDICRIME Convention. The Convention establishes several offences such as the manufacturing, supplying, offering to supply and trafficking in counterfeit medical products, as well as the unauthorised manufacturing or supplying of medicinal products and the marketing of medical devices that do not comply with conformity requirements. This course aims at assisting legal professionals to appropriately address pharmaceutical crime.
This HELP course on the Environment and Human Rights is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. The protection of the environment and the protection of human rights are interconnected: one cannot be achieved without the other, nor at the expense of the other. Life and well-being on our planet are contingent on our collective capacity to guarantee both human rights and a healthy environment to future generations. A human rights-based approach-using human rights laws and mechanisms in the context of environmental impacts -offers an innovative and evolving tool for environmental protection. A number of international human rights standards, including the European Convention on Human Rights and the European Social Charter, have successfully been invoked in environmental issues. Furthermore, the jurisprudence of the European Court of Human Rights and the case-law of the European Committee of Social rights affirm the undeniable inter-connections between environmental protection on the one hand and human rights on the other. This course aims at supporting legal professionals and others in understanding the connections between human rights and the environment, in particular how to apply a human rights-based approach to environmental protection.
This HELP course on the Introduction to the European Convention on Human Rights and the European Court of Human Rights is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals (HELP) of the Council of Europe aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. The European Convention on Human Rights (ECHR) is the most important instrument of the Council of Europe. The ECHR constitutes an important part of the everyday practice of legal professionals. In order to apply it properly, national actors need to have basic knowledge on the ECHR and how it is interpreted by the ECtHR. This course aims to provide this necessary basis. It offers a possibility to be acquainted both with the text of the ECHR itself and with the methodology and the procedure followed by the ECtHR in interpreting it. The course is addressed to legal professionals (judges, prosecutors, lawyers).
This HELP course on the Right to the Integrity of the Person (Bioethics) is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals in the European Union member states (HELP in the EU) of the Council of Europe, with EU financial support, aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. The right to integrity of the person is a very important aspect of bioethics (biology and medicine). This course aims at assisting legal professionals to better identify situations of potential violations of the right to integrity of the person within the fields of medicine and biology and to apply the relevant legal framework their daily work. The course covers in an interactive way synergies and differences between the Charter of Fundamental Rights of the EU, the European Convention on Human Rights and the Convention on Human Rights and Biomedicine (Oviedo Convention). It also reviews the case-law of the European Court of Human Rights (ECtHR) and the Court of Justice of the European Union (CJEU) pointing out to problems such as medical interventions or removal of organs without consent, medically assisted procreation, physical abuse and end-of-life situations. This HELP course on the Rights of Persons with Disabilities is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals (HELP) of the Council of Europe, with EU financial support, aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. Legal professionals are at the front line in that respect, with their work being of critical importance in ensuring the effective and efficient protection of the rights of persons with disabilities. This comprehensive course aims at increasing the knowledge of legal professionals on the applicable international and CoE standards for a better protection of the rights of persons with disabilities. Throughout the course international standards on rights of persons with disabilities under the UN Convention on the Rights of Persons with Disabilities (UNCRPD) and the CoE instruments (European Convention on Human Rights –ECHR, the revised European Social Charter-ESC(r) and soft law documents) will be identified and compared. The course is addressed to legal professionals (judges, prosecutors, lawyers).
This HELP course on the standards of the Council of Europe Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals (HELP) of the Council of Europe (CoE) aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. The course was developed in cooperation with the Council of Europe Commitee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT) and with the support of the Project “Strengthening the application of the European Convention on Human Rights in Georgia”, under the European Union-Council of Europe Partnership for Good Governance. It aims at preventing ill-treatment of persons deprived of their liberty and familiarizing legal professionals with the CPT’s key standards concerning the five most important places of deprivation of liberty: police stations, prisons, immigration detention facilities, psychiatric establishments and social care homes.
This HELP course on Violence Against Women and Domestic Violence is part of a series of courses created by the European Programme for Human Rights Education for Legal Professionals aiming to support legal professionals and to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level. Violence against women is a grave violation of human rights and a form of discrimination against women. This comprehensive course aims at improving the quality of the judicial response in violence against women cases and supporting the access to justice for victims of violence. It covers in an interactive way the international and European legal framework and case-law governing the prevention and protection of women and girls from violence, focusing in particular on the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence (Istanbul Convention). Furthermore, the course provides legal professionals with practical tools for dealing with cases of violence against women and domestic violence with respect to a human rights and victim centred approach. The European Programme for Human Rights Education for Legal Professionals in the European Union member states (HELP in the EU) supports legal professionals to enhance their capacities to effectively and coherently apply European fundamental rights standards at the national level and through cross-border training, mainly referring to the EU Charter on Fundamental Rights (the Charter), the European Convention on Human Rights, the European Social Charter and relevant EU and Council of Europe Law via a series of online courses. The HELP online courses are addressed to legal professionals (judges, prosecutors and lawyers). They cover various human rights related topics, reflecting the different areas of work of the Council of Europe.
This series of handbooks cover the following topics: the right to respect for private and family life, the right to a fair trial, the right to personal liberty and security, freedom of thought, conscience and religion; freedom of expression, the right to property, the prohibition of torture, the right to life and the protection of migrants.
Generally, the three EU directives are quite well implemented in the Hungarian legal environment at the theoretical level. However, there are still discrepancies in everyday practice regarding compliance with the directives.
